These Terms & Conditions ("Terms") govern your use of hearty’s mobile application and website (the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old (or the minimum age required by your jurisdiction) to use the Services.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use or suspected breach of security.

3. Subscriptions, Free Trials, and Billing

  • In‑App Purchases: If you purchase a subscription, the transaction is processed by Apple via App Store in‑app purchases. Apple’s terms and privacy policies apply. We do not collect your full payment card details.
  • Auto‑Renewal: Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple ID account settings.
  • Free Trials: If offered, trials convert to paid subscriptions unless canceled before the trial ends.
  • Refunds: Refunds for iOS purchases are managed by Apple. Please request refunds via Apple support.

4. Acceptable Use

  • Do not use the Services for unlawful, harmful, or abusive purposes.
  • Do not attempt to reverse engineer, decompile, or interfere with the Services.
  • Do not upload content that is illegal, infringing, or violates others’ rights.
  • Do not access the Services using automated means without permission.

5. User Content

You retain ownership of content you submit. You grant hearty a non‑exclusive, worldwide, royalty‑free license to use, reproduce, and display your content solely to operate and improve the Services. You represent you have the necessary rights to submit the content.

6. Intellectual Property

The Services, including software, text, images, and trademarks, are owned by hearty or its licensors and are protected by intellectual property laws. Except for the rights expressly granted to you, no rights are transferred.

7. License

Subject to these Terms, we grant you a limited, non‑exclusive, non‑transferable, revocable license to use the app on Apple‑branded products you own or control and as permitted by the App Store Terms of Service.

8. Third‑Party Services

The Services may integrate with or link to third‑party services. We are not responsible for third‑party content or practices. Your use of such services is subject to their terms and policies.

9. Privacy

Your use of the Services is subject to our Privacy Policy.

10. Disclaimers

The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including fitness for a particular purpose, non‑infringement, or availability. We do not provide medical, legal, or professional advice; the Services are for informational purposes only.

11. Limitation of Liability

To the maximum extent permitted by law, hearty and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising from your use of the Services. Our aggregate liability will not exceed the amount you paid to us for the Services in the twelve months preceding the claim, or $50 if greater.

12. Indemnification

You agree to defend, indemnify, and hold harmless hearty and its affiliates from any claims, liabilities, damages, losses, and expenses arising from or related to your use of the Services or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Services at any time for any reason, including if you violate these Terms. You may stop using the Services at any time. Certain provisions survive termination.

14. Governing Law; Dispute Resolution

These Terms are governed by the laws of your country or state of residence, without regard to conflict of laws, unless local law requires otherwise. Disputes will be resolved in courts with jurisdiction over your residence, unless mandatory local consumer laws provide you alternative rights.

15. Changes to the Services and Terms

We may modify or discontinue the Services at any time. We may update these Terms from time to time. We will post the updated Terms at https://www.heartyapp.com/terms with the effective date above. Material changes will be notified in‑app or by other reasonable means.

16. Apple‑Specific Terms

  • These Terms are between you and hearty, not Apple. Apple is not responsible for the app or its content.
  • Apple has no obligation to furnish any maintenance or support services for the app.
  • In the event of any failure of the app to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the app.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and that you are not on any U.S. Government list of prohibited or restricted parties.
  • You acknowledge and agree that Apple and Apple’s subsidiaries are third‑party beneficiaries of these Terms and that upon your acceptance of the Terms, Apple will have the right to enforce the Terms against you as a third‑party beneficiary.
